1. Introduction and Acceptance:

Welcome to Jade Lady Tai Chi and Qigong, a tai chi and qigong school, and online store. By accessing this website or purchasing any products from Jade Lady Tai Chi and Qigong, you accept and agree to be bound by these Terms and Conditions. If you do not agree, you must not use this website or purchase any products.

2. Description of Products and Services:

Jade Lady Tai Chi and Qigong offers:

  • Online tai chi and qigong courses for students and instructors, accessible after a one-off fee or via a payment plan. These courses are available immediately after purchase with no time limit for completion. Assessment-based courses require successful completion for certification.

  • Digital illustrated posters for download upon purchase.

  • en-pack class vouchers for face-to-face classes, issued as a Club Card with no usage time limit.

3. Disclaimer of Liabilities:

While we aim for high quality, we do not guarantee that our website or its contents are error-free. By purchasing our online courses, you affirm that you are fit to follow the exercises and assume responsibility for any injuries. Consult a healthcare professional before starting any new fitness program. Consumer rights under the Australian Consumer Law (ACL) apply and cannot be excluded.

4. Usage Rules and Conduct:

You must not engage in any unlawful, defamatory, obscene, offensive, bullying, harassing, misleading, or deceptive conduct. Downloadable posters are for personal use only and may not be reproduced or distributed. Online courses are for individual use only, and sharing access is prohibited. Blog articles and free videos can be shared non-commercially.

5. Intellectual Property Rights:

All content and design belong to Suzette Hosken, owner of Jade Lady Tai Chi and Qigong. Unauthorised use, reproduction, or distribution of these materials is prohibited and may result in legal action.

6. Payment Terms:

All prices are in Australian dollars and subject to change without notice. Payment methods include Stripe, PayPal, or electronic funds transfer by arrangement. No GST is charged. Payments must be received before product access is granted.

7. Refunds and Cancellations:

Under Australian Consumer Law, we're not obliged to refund for change of mind. However:

  • For online courses, refunds (minus 8% platform fees) are available within 7 days if expectations are not met. No refunds will be given after 7 days.

  • No refunds will be given for digital posters unless they are defective.

  • Refunds for unused classes on Club Cards are available within 28 days of purchase (minus 8% platform fees if purchased using Stripe or PayPal). After 28 days, refunds aren't offered, but cards can be resold to other students. 

All refund requests will be addressed within one week.

8. Delivery of Digital Products:

Digital products are available immediately after purchase, with links sent via email. If you do not receive this email, please check your spam folder and mark the email as ‘not junk’ to receive future emails from Jade Lady Tai Chi and Qigong. If no email is received, please contact customer support at info@jadeladytaichi.com.au

9. Account Registration:

To make a purchase, create an account and provide billing information. Once registered, you can access your products via the dashboard. Your personal data will be managed in accordance with our Privacy Policy and used only for processing your orders.

10. Termination:

Accounts may be terminated for breaching these terms, such as unauthorised reselling of our materials. Notifications will be issued in such cases.

11. Privacy and Data Protection:

12. Third-Party Links:

Our website may contain links for your convenience. We are not responsible for the content or practices of these third-party sites and do not endorse them.

13. Governing Law:

We reserve the right to modify these terms at any time. Changes will be communicated through our website or via email, and it is the user's responsibility to stay informed.
